Overview
These Terms of Service govern your access to and use of TunnelTime, including the TunnelTime website, admin portal, APIs, command-line interface, and hosted tunnel relay services.
By accessing or using TunnelTime, you agree to these Terms. If you do not agree, do not use TunnelTime.
TunnelTime is offered as a free beta service. It may change substantially, be interrupted, or be discontinued at any time.
Eligibility
You must be at least 13 years old to use TunnelTime.
If you use TunnelTime on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The Service
TunnelTime lets users create and manage HTTP and TCP tunnels that relay traffic between public endpoints and local services selected by the user.
Subject to these Terms, TunnelTime grants you a limited, revocable, non-exclusive, non-transferable right to use the service and any provided CLI or related software solely in connection with your lawful use of TunnelTime.
TunnelTime reserves all rights not expressly granted in these Terms.
User Accounts, Tokens, and Security
You are responsible for:
- maintaining the confidentiality of your agent tokens, admin credentials, and local configuration files
- all activity that occurs using your credentials, devices, tunnels, or exposed services
- keeping your contact and account information accurate where applicable
- promptly stopping use and contacting TunnelTime if you suspect unauthorized access or misuse
You must not share tokens or credentials in a way that permits unauthorized use of the service.
Acceptable Use
You may use TunnelTime only in compliance with these Terms and applicable law.
You must not use TunnelTime to:
- violate any law or regulation
- infringe or misappropriate another person’s rights
- expose, distribute, or transmit unlawful, harmful, fraudulent, defamatory, or deceptive content
- distribute malware, ransomware, spyware, or other malicious code
- engage in phishing, credential theft, fraud, spam, or deceptive practices
- perform denial-of-service attacks, port scanning, vulnerability exploitation, or unauthorized access attempts
- expose services, systems, or data that you do not own or have permission to make available
- interfere with the integrity, security, or performance of TunnelTime or third-party systems
- evade rate limits, suspensions, revocations, or other service restrictions
- reverse engineer or misuse the service except to the extent such restriction is prohibited by law
TunnelTime may investigate suspected misuse and cooperate with law enforcement or affected third parties when appropriate.
Your Content and Exposed Services
You are solely responsible for:
- the services, applications, websites, or ports you expose through TunnelTime
- the content, data, and traffic transmitted through your tunnels
- obtaining all rights, notices, and permissions necessary for your use of TunnelTime
- securing your local systems and any data made available through your tunnels
You represent and warrant that you have all rights and permissions necessary to expose and transmit the content, services, and systems you make available through TunnelTime.
TunnelTime does not claim ownership of your content. However, you grant TunnelTime the limited rights necessary to host, route, cache, copy, transmit, and otherwise process your content and traffic solely to operate, secure, and improve the service and to enforce these Terms.
Privacy
Your use of TunnelTime is also subject to the TunnelTime Privacy Policy. That policy explains how TunnelTime collects, uses, and shares information.
Suspension, Revocation, and Termination
TunnelTime may, at any time and without prior notice, suspend, rate-limit, restrict, revoke, remove, or terminate access to any user, admin account, agent, tunnel, domain, or connection if TunnelTime believes:
- you violated these Terms
- your use creates security, legal, or operational risk
- your use harms TunnelTime, its users, or third parties
- suspension or termination is necessary to investigate abuse or comply with legal obligations
You may stop using TunnelTime at any time. Termination does not limit any rights or remedies that arose before termination.
Beta Service and Changes
TunnelTime is a beta service. You understand and agree that:
- features may be added, changed, or removed without notice
- service limits, tunnel behavior, or infrastructure may change at any time
- the service may experience bugs, outages, data loss, interruptions, or security issues
- TunnelTime may discontinue the service in whole or in part at any time
TunnelTime has no obligation to continue supporting any feature, interface, or workflow.
No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNNELTIME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
TUNNELTIME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR THAT ANY DEFECTS WILL BE CORRECTED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Damian Andre WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO TUNNELTIME OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF Damian Andre FOR ALL CLAIMS ARISING OUT OF OR RELATING TO TUNNELTIME OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- fifty U.S. dollars (USD $50), or
- the amount you paid to TunnelTime for the service in the 12 months before the event giving rise to the claim
Because TunnelTime is currently a free beta service, that amount will often be zero.
Some jurisdictions do not allow certain liability limitations, so some of the above limitations may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless Damian Andre from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of TunnelTime
- your content, traffic, tunnels, or exposed services
- your violation of these Terms
- your violation of applicable law
- your violation of any third-party rights
Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
To the extent a dispute is permitted to proceed in court, you and TunnelTime agree to the exclusive jurisdiction and venue of the state or federal courts located in Utah, USA.
TunnelTime may operate infrastructure or process data in other jurisdictions, including Sydney, Australia, but those operational arrangements do not change the governing law or venue stated in these Terms.
Changes to These Terms
TunnelTime may update these Terms from time to time. The updated version will be posted with a revised effective date. By continuing to use TunnelTime after updated Terms become effective, you agree to the revised Terms, to the extent permitted by law.
General
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
Failure to enforce any provision is not a waiver.
You may not assign these Terms or any rights under them without prior written consent. TunnelTime may assign these Terms in connection with a sale, transfer, or reorganization of the service or its assets.
These Terms, together with the Privacy Policy, are the entire agreement between you and TunnelTime regarding the service.
